Chapter One: Addressing The Melanie Martinez And Timothy Heller Statements

On 12/04/2017, Timothy Heller accused former friend Melanie Martinez of sexual assault during a two-night sleepover they had on 2015. Pause and read.

There is something off about Timothy's letter from the start. Timothy said that she never meant to name Melanie as her abuser while she was writing her letter, and she only decided to name Melanie in the tweet (which is separated from the letter) moments before posting it.
Media image
13
13/300

People disagree as there is enough info to identify Melanie as her alleged abuser without the need of naming her. For example: Timothy stating that her alleged abuser has a dedicated group of fans. This directly means that the person in question is a public figure/famous.
Media image
14
14/300

Timothy doubles down on this point stating that some of her alleged abuser fans became her fans, but eventually they stopped supporting Timothy. So not only this person is famous, but also they share interests or careers similar enough for them to share the same fanbases.
15
15/300
From what I had researched the only people who Timothy was friends/acquaintances at the time who fit these criteria (a female best friend who is also famous singer) was either Melanie or Abigail Breslin, and Abigail's main fanbase comes from her acting and not her singing.
Media image
16
16/300

Also please don't send hate to Abigail Breslin as the only reason I mentioned her is to get my point across better. I'm not going to mention her again expect for a specific point that I'm going to bring up way later on so put a pin on that. Side note over, let's continue.
17
17/300

The point that I'm trying to make is that people could had identify Melanie as Timothy's alleged abuser in her letter without the need of explicitly naming Melanie. All it would have taken is a little effort & being capable enough to pick-up the context clues in her post.
18
18/300
There are also rumors that Timothy originally planned to accuse her former band member from Dresses (Jared) of sexual assault and later changed her alleged abuser's name and pronouns to Melanie. This is completely unfounded since there's no evidence that support the claim.
Media image
19
19/300
While it's true that Timothy did in fact accuse Jared Ryan of mental abuse back in October 2017, the accusations made against Jared and the accusations made against Melanie are two completely different subjects that deserve their own rigorous research and thorough analysis
Media image
20
20/300
Jared never came forward defending himself against the accusations made by Timothy so either he's not aware that he was accused of mental abuse or he is aware and decided to stay silent. Needless to say: Do not send any hate to Jared either.
Source: atwoodmagazine.com/th-sleep-timot…
22
22/300
If Timothy's true intentions were to not named her alleged abuser (or at least make it less easy for people to not identify her alleged abuser) she would have opted to use gender neutral pronouns instead. But people have bigger/more important observations than all of this.
23
23/300

Timothy claimed that one of the reasons she posted her letter was because she got encouraged by #MeToo. The purpose of #MeToo is to build a community where survivors (particularly young women) feel comfortable to come forward and share their personal experiences of abuse.
Media image
24
24/300

#MeToo was never meant to be used as a tool/instrument to accuse others. If you read #MeToo stories from other people before and after 2017 you will notice that their posts are lived personal experiences to help other women and were never meant to be taken as accusations.
25
25/300
Timothy said that the reason she posted her letter is to help women but there are no signs in her original post that support this idea except of the last paragraph which, simply put, doesn't fit it in with the rest of the body of text and could be read as an after-thought.
Media image
26
26/300
Timothy being a mental health supporter and an advocate for sexual assault survivors should had known the difference between sharing an alleged lived personal experience of abuse and openly accusing a person and justifying it by utilizing real #MeToo stories posted online.
27
27/300
For some people (including real survivors of sexual assault & violence) this is enough reason to doubt Timothy's real intentions of posting her letter, and other eyebrow-raising behavior that we will discuss later. But for now, we are going to address Melanie's statements.
28
28/300
In the late hours of 12/04/2017 Melanie released her first official statement denying Timothy's accusations. Melanie's response (11:37PM PST) was posted roughly six hours later after Timothy's post (5:56PM PST).
Pause and read.

29
29/300
Before analyzing both Melanie & Timothy's statements I need to be really clear: It's not out of place for me to say that both statements were poorly written and most of these controversies could had been avoided if the two of them had taken more time to write them properly
30
30/300
I understand that both of them have anxiety and difficulty asserting themselves but it comes to a point when you need to be more assertive while addressing these serious topics if you don't want people to take your words out of context and painting a picture that is false.
31
31/300
This is a tip for everyone reading this: If you are accused of a crime you didn't commit, your common sense & judgement are your best allies. Don't rush a statement that people will take out of context no matter how well written it is and consult a legal team if necessary.
32
32/300
My most sincere apologies for the next portion of this thread but I really need to drive this point home. The general public misquoted Melanie's statement as "she never said no" instead of quoting her full statement which was "she never no to what we chose to do together."
Media image
33
33/300
Now, "she never said no to what we chose to do together" is a poorly written statement and it should be called out. A 22-year-old woman should had known better and not address these serious accusations like this. However, a poorly written post is not an admission of guilt.
34
34/300
I'm aware of the implications behind the phrase "she never said no" and its negative connotations surrounding it. However, Melanie was not using the phrase in that way and she was not contributing to rape culture by using it. Context is key and understanding is everything.
35
35/300
"She never said no to what we chose to do together" was a direct response to Timothy's letter where she stated that she repeatedly said no to the idea of having sex. The verb “chose” expresses consent as it was a choice between them. Melanie was just denying her statement.
36
36/300
The reason why Melanie's statement was misinterpreted is because most people did not read Timothy's letter so they did not know the full meaning and context behind her response.

Timothy: "I repeatedly said no."
Melanie: "She never said no to what we chose to do together."
Media image
37
37/300
• More examples:

"I said no"
"She never said no to what we chose to do together"

"I said every form of no I could think of"
"She never said no to what we chose to do together"

"I never said yes. I said no, repeatedly"
"She never said no to what we chose to do together"
Media image
Media image
Media image
38
38/300
If person A says: "I was sexually assaulted by person B, I repeatedly said no to the idea of having sex" and person B says: "That's not true, she never said no to what we chose to do together" is an odd yet understandable response. Her wording was awful but awful ≠ guilty
39
39/300
If Melanie had worded her post differently people would still attack her. For example, if Melanie said "she said yes to what we chose to do together" people would have quoted the part in Timothy's post that read "I never said yes. I said no, repeatedly" and call her a liar
40
40/300
Is a lose-lose situation, a zugzwang: If she had taken the legal route people would've accused her of silencing her "victims." If she had remained silent they would've attacked her for not taking it seriously. She responded and now she's still being attacked because of it.
Media image
41
41/300
Decontextualizing someone's words and then using it against them is a bad argument. If you explain to someone in the clearest & earnest way possible the meaning of something but they keep doubling down and counter-acting the impossible, the fault lands on them, not on you.
42
42/300
Melanie isn't saying that she took advantage of Timothy because she "never said no," Melanie is stating that their encounter was consensual because, contrary to Timothy's letter, she didn't object to the sexual activities they chose to do together. A choice requires agency
43
43/300
They had consensual sex. Now, why was Melanie's statement so ambiguous? To my understanding, it may had been written that way to dissuade people from reading Timothy's letter. But also remember that Melanie didn't identify as part of the LGBTQ+ community back in Dec, 2017.
44
44/300

Melanie came out as bisexual during a Q&A on July 2018 at her own pace and timing. And I am not saying that survivors of SA shouldn't out their alleged abusers if they are LGBTQ+. I'm saying that from Melanie's POV she was outted worldwide and her sexuality became a show.
Media image
45
45/300
Both of Melanie and Timothy's sexualities became a spectacle for everyone to have an opinion on and comment on. Millions of people using this situation to incorrectly justify their misogyny, homophobia and biphobia towards them. And I, personally, don't think that is fair.
Media image
Media image
46
46/300
Melanie Martinez released a second official statement on December 9th, 2017 where she reaffirms her innocence expressed on her previous letter by stating "I would never be intimate with someone without their absolute consent."

Source [Broken Link]:
Media image
47
47/300
Despite Melanie saying "I would never be intimate with someone without their absolute consent," people misquote her statement on purpose. They continue to misquote it as "she never said no" instead of "I would never be intimate with someone without their absolute consent."
Media image
48
48/300

Because the quote "I would never be intimate with someone without their absolute consent" doesn't help them push this narrative of Melanie being a self-admitted rapist. Melanie stated that they engaged in consensual sex but never stated a specific date. Put a pin on that.
49
49/300
Now, we have encountered a dilemma. We have two people that had posted very poorly written statements that are diametrically opposed to one another & completely contradict each other. How can we determine who is telling the truth and who is lying? Where do we go from here?
50
50/300
Chapter Two: By The Numbers
People had already made up their minds at this point. Some people decided to support Melanie, others decided to support Timothy. Some separate the art from the artist (an ethical debate with its pros and cons), others disengage from their music.
Media image
51
51/300
But you can't support them both because that's a middle ground fallacy: Both of them can't be telling the truth at the same time. Because SA is a predetermined/intentional act of violence: You can't accidentally SA someone. An intention is a deliberate act, not an accident
52
52/300
One of the points used against my older thread is to mention the misguided belief that only 1 out of 200 SA cases are false. I understand the concerns and I'm going to address this. The goal of this chapter is to recontextualize this argument from an ethical point of view.
53
53/300

First, we need to know if the data comes from a reputable source. The debate that only 0.5% cases of SA are false comes from a 2010 study titled "Rape: Too Hard To Report And Too Easy To Discredit Victims" published by criminologist Joanne Belknap:
journals.sagepub.com/doi/10.1177/10…
Media image
54
54/300
She backed-up her study by citing an article titled "False Allegations Of Sexual Assault: An Analysis Of 10 Years Of Reported Cases" made by psychologist David Lisak (2010). In the article he analyzed all cases of SA reported to a University in Boston over a 10-year period
Media image
55
55/300
Lisak and his team concluded that 8 out of 136 cases had sufficient ground to be qualified as false accusations (roughly 5.9%). The study took into account older research which indicated that the prevalence of false SA accusations is between 2%-10%.
pubmed.ncbi.nlm.nih.gov/21164210/
Media image
56
56/300
If Lisak said that 5% or 1 out of 20 reported cases of SA are false, then why did Belknap said that 0.5% or 1 out of 200 reported cases of SA are false? That's because Belknap took into account the percentage of SA cases that are never reported/notified to the authorities.
57
57/300

Belknap said that because 90% of SA cases are never reported to the police, the total amount of rape cases (including those reported and not reported to the police) consists of 99.5% real cases and 0.5% false cases. So, is it accurate to say Belknap is a reputable source?
58
58/300

The short answer is "yes." But the long answer is way more complicated. The problem arises when you realize that the determinant factors that decide the percentage of false SA accusations change depending on your source. That is where the margin of error comes into place.
59
59/300
The determinant factors that decide the percentage of false SA cases include the prevalence of false SA cases, the percentage of SA cases that aren't reported to the police, the sample size, the time period, the time frame in which the study took place and other variables.
60
60/300
Joanne Belknap concluded that 1 out of 200 SA cases are false based on a study in which the determinant factors used were: A 5% prevalence of false SA cases, a sample size of 136 cases over a 10-year period & a 90% percentage of SA cases that aren't reported to the police.
61
61/300
In contrast, a 2018 article published by CNN: "Trump Says It's A 'Scary Time' For Men. Here Are The Stats On False Sexual Assault Claims," The National Sexual Violence Resource Center states that the prevalence of false SA cases is between 2% & 10%.
edition.cnn.com/2018/10/03/hea…
Media image
62
62/300

In a study of SA cases reported to the LA Police Department in 2008, researchers found that the rate of false reports was 4.5% (Spohn, White, & Tellis, 2014). "What Percentage Of Rape Reports Are False?" by End Violence Against Woman International:

Media image
63
63/300
In a multi-site study of 8 U.S. communities made by the Making A Difference Project, 140 out of 2,059 SA cases reported in a 18-24 month period were classified as false (roughly 7%).
The National Center for the Prosecution of Violence Against Women:
nsvrc.org/publications/a…
Media image
64
64/300
To give a summary before continuing, we can determine that the prevalence of false SA accusations depends on the sources used:

• CNN (2018) & NSVRC (2012): Between 2% & 10%
• LAPD (2008): 4.5%
• Lisak (2010): 5%
• NCPVAW (2009) & Making A Difference Project (2009): 7%
65
65/300
And while all of the sources cited previously come from US Territory, statistics regarding the prevalence of false SA cases appear to coincide internationally. In a study published by London Metropolitan University 2,643 reported SA cases were studied over a 15-year period
Media image
66
66/300

During the study, the researchers and the British Police differed on the real percentage of the prevalence. Initially, the Police concluded that the prevalence of false SA cases was 8%. However, the researchers concluded that the prevalence of false SA accusations was 2%.
Media image
67
67/300

The range between 2%-8% obtained from London Metropolitan University aligns with the range between 2%-10% reported by The NSVRC.

"Home Office Research Study 293: A Gap Or A Chasm? Attrition In Reported Rape Cases" by London Metropolitan University
researchgate.net/publication/23…
Media image
68
68/300
Going down from 10% to 2% is a decrease of 8 percent points or an 80-percent decrease and moving up from 2% to 10% is an increase of 8 percent points or a 400-percent increase. These numbers can't be ignored. They reflect a real problem in the prevalence of false SA cases.
69
69/300

Estimates of the rate of false reports vary widely because the criteria used in the police vary in each state. The Uniform Crime Reporting Program (NSVRC, 2012) identifies three main ways to clear a case: Cleared by arrest, cleared by exception and the unfounded category.
Media image
70
70/300
Subdivisions for the unfounded category
False Report: A reported crime to law enforcement that an investigation factually proves never occurred.
Baseless Report: One in which it's determined that the incident doesn't meet the elements of the crime but is presumed truthful.
71
71/300
Not all cases of false reports are attributed to malicious intentions, as there has been instances of improper documentation & mistaken identification in some incidents. A report can only be classified as a false report once a proper investigation/study has been concluded.
72
72/300

None of the five studies I cited earlier took into account SA accusations made on social media, only crime data that has been voluntarily submitted to the police & law enforcement. To say that these organizations also study SA accusations posted online is a great mistake.
73
73/300

Police department/law enforcement don't investigate SA accusations posted on social media because their priority is to process SA accusations that are already reported in their agencies. Investing police time/resources in SA accusations posted online is counterproductive.
74
74/300

Sexual assault & rape accusations posted on social media don't have journalists to verify the accuracy of the information that is being posted. These types of accusations don't need to meet any of the requirements or criteria used in the police department/law enforcement.
75
75/300
Someone who has malicious intentions to falsely accuse others would choose to accuse them online instead to the police. Thus, their accusation could not be classified as a false report and it would not be part of the prevalence of false SA cases. If you're falsely accused:
Media image

As criminologist Dr. Brent Turvey (AP News, 2020) has stated: "[The two-percent figure] is not only inaccurate, but also it has no basis in reality. Reporting it publicly as a valid frequency rate with any empirical basis is either scientifically negligent or fraudulent."
Media image
77
77/300
He added: "The power of any lie is equal only to our desire to believe it. [...] Specifically, our need and eagerness to believe it. This is the problem with belief, which is accepting something as true or correct without proof."

Once explained the prevalence of false SA cases, we can now define the percentage of all rape cases that are never reported to the police. The NSVRC states that 63% of sexual assaults are not reported to the police.

80/300
If you calculate the percentage of false SA cases based on the lowest rate in the prevalence of false SA cases (2%) and the highest rate in the percentage of SA cases that are never reported to the police (90%) the answer is 0.2% (one out of 500 SA cases are false reports)
81
81/300
If you calculate the percentage of false SA cases based on the highest rate in the prevalence of false SA cases (10%) & the lowest rate in the percentage of SA cases that are never reported to the police (60%) the answer is 4% (twenty out of 500 SA cases are false reports)
82
82/300
If Person A states: "Only one in 500 cases of SA are false reports" and Person B responds: "In reality only twenty in 500 cases of SA are false reports," they are both correct and wrong at the same time. This phenomenon is known as true contradictions/contradictory truths.
Media image
83
83/300
Another example is the Zen Buddhist Philosophy of "not one, not two." Zen Buddhism rejects both dualism (two) and monism, or non-dualism (one). In other words: It is not entirely accurate to say everything is separate, but it is also not accurate to say that we're all one.
Media image
84
84/300
If someone picks 500 SA cases at random 19 SA cases will fall under the margin of error. And this result is only obtained by taking the numbers at face value. We haven't addressed societal issues as minority groups are more likely to be accused of crimes they didn't commit
85
85/300

We do not live under a misconstrued utilitarian theory of ethics where punishing a potentially innocent person is morally justified. Political philosopher Stephen Nathanson points out the importance of justice, rights and the normative concept of desert in legal dilemmas:
Media image
86
86/300

"[Rule utilitarians] don't reject concepts like justice, rights, and desert. Instead, they accept and use these concepts but interpret them from the perspective of maximizing utility." He then mentions the problems of wrongful convictions, as it poses a challenge to them:
87
87/300
"While we hope that our [criminal justice system] gives people fair trials and conscientiously attempts to separate the innocent from the guilty, we know that the system isn't perfect. As a result people who are innocent are sometimes [punished] for crimes they didn't do."
Media image
88
88/300
He concludes that both Act & Rule utilitarians build their morality by setting a relationship between their moral code & moral perspective (how their actions impact others).

Rape cases go beyond numbers and statistics. A thorough analysis of each and every single case is the only way to guarantee the well-being of everyone involved. To dismiss all cases as "there is no need to investigate because 99.5% are telling the truth" is irresponsible.

Chapter Three: The Pieces Of Evidence Found
Timothy corroborated her statements by giving 2 pieces of evidence: The first piece of evidence was a pic of Melanie during the alleged sleepover which was sent to Newsweek. The second piece of evidence was a video of her iCloud.
Media image
Media image
91
91/300
On December 5th, 2017, the day after she posted her statement, Timothy did an exclusive interview with Newsweek addressing the allegations. The article was written by Emily Gaudette. Read the interview in full before continuing this thread.
Archive: web.archive.org/web/2017050100…
92
92/300
This is the (alleged) timeline of events presented by Timothy in the article:

• The night of June 24th, 2015: The night of the first sleepover.
• The night of June 25th, 2015: The night of the second sleepover.
• The day of June 26th, 2015: The day after the sleepover.
93
93/300

This part is important: I am going to provide context as to why the dates presented on the Newsweek article were June 24th-June 25th and not June 25th-June 26th. The article describes June 25th as: "[The night in question when] Martinez pressured her into sexual contact."
94
94/300
In Timothy's original statement the alleged abuse happened on the second night of the sleepover and not on the first night. The article states that Melanie pressured Timothy into sexual contact on June 25, making June 24-June 25 the more accurately depicted/portrayed dates
95
95/300

Because if June 25 and June 26 were the dates actually presented, that would contradict Timothy's own timeline of events by describing the first night of the sleepover (in this hypothetical case being June 25) as the night of the alleged abuse instead of the second night.
96
96/300
In either case the sleepover did not start on neither June 24th or June 25th. Melanie and Timothy actually meet on June 26th. This claim is backed up by Timothy's iCloud and social media posts which we will look over later. Let's go back into discussing Timothy's evidence.
97
97/300

The first piece of evidence Timothy provided was the pic used in the Newsweek article with the caption: "Martinez on the night in question in 2015, allegedly playing the sexual game Heller says she took way too seriously." The night of the sleepover being June 25th, 2015.

This is supposed to be a never seen before pic but you can find a reupload from February 2017. That's because Timothy liked to take Snapchat stories when she used to spend time with Melanie.

The game Melanie and Timothy were playing is called "Valentine's Day Lover's Kit." Its description reads: "One wears the blindfold while the other rolls the dice to reveal the action of love on each turn." The game was not mentioned/referenced in Timothy's original letter

Some people speculate that the part in Timothy's statement where Melanie kept asking for permission to touch Timothy's body parts such as her arms happened while they were playing the Lover's Kit game. This paragraph is just an observation and shouldn't be taken as a fact

In her letter, she said that the incident happened while she was trying to sleep in bed and the game was not mentioned/referenced. In the article, she said that the incident happened while they were both awake playing the game and not while she was trying to sleep in bed.
107
107/300
These two events are mutually exclusive: They can't happen at the same time. You can't pretend to be falling asleep in bed & ignoring someone's unsolicited sexual advances while simultaneously being awake & playing a two-player game you didn't mentioned in the first place
Media image
108
108/300
The kit was an unnecessary detail that she added in her story & try to make it more believable but the result was the opposite. Her accusation went from "I was abused while I was pretending to be asleep in bed" to "I was abused while we were awake playing a 2-player kit."
109

Liars add unnecessary details, which will eventually contradict each other. We can also confirm that the pic was taken on 05/06/2015 based on Melanie's hair color throughout social media posts around that time:

Melanie was on tour at the time. The tour ended on June 21st, 2015 but she stayed in New York for a couple of days because she was born in NYC and probably visited some relatives after the tour ended. Here's a video of her performing at The Webster Hall on June 21st, 2015

Melanie couldn't had stayed at a sleepover in Los Angeles, California on June 25th, 2015 because she was in New York on that exact same day. Remember, Timothy said that the sleepover lasted for two nights straight which is impossible

Timothy & Melanie had several sleepovers over 2015. Melanie couldn't have possibly known which sleepover Timothy was referring to because Timothy, intentionally or not, combined different aspects/details from all their sleepovers and tried to present it as one sleepover.

Timothy Heller wants people to believe that these two photos were taken over the span of a day: Being the first pic taking place on June 24, 2015 (photo actually taken on May 6, 2015) and the second pic taking place on June 25, 2015 (photo actually taken on June 26, 2015)

vs.

Melanie Martinez's argument: These twelve pictures were taken over the span of one and a half months.

The second and final piece of evidence Timothy gave was an iCloud video she posted on Twitter on Dec. 30th, 2017. We can confirm that the tweet is real thanks to a quoted reply. They were questioning if it's normal for iCloud to display the dates wrong on your camera roll

Timothy stated in the deleted tweet that she got the dates wrong because her iCloud was messed up but I will explain in a second why her iCloud was working just fine.

For example, you can see in the video that she has a pic of a party saved on 06/24/2015. The party happened on June 21st. Since Timothy's iPhone did not took the pic, June 24th is the day that the pic was automatically saved by her iCloud.

149
149/300
Regardless if Timothy was the one who introduced Melanie into cannabis or not, smoking weed was a common activity they did together. In the article, Timothy said that she & Melanie used to smoke all day during tour so it's unlikely that Timothy was pressured into smoking.

We will address some of the possibilities on when did the friendship ended with its implications and interpretations later so put a pin on that. But for now, we are going to rely on Timothy's posts from Jan. 2017 in which she stated that she was still friends with Melanie
158
158/300
The reason why Timothy lied about stop being friends with Melanie in 2016 was not because of trauma but because by telling people she stopped being friends with Melanie for years and distancing herself from Melanie she attempted to make her statements seem more believable
159
159/300
People will attack you for pointing this out. But please keep in mind that unlike most cases of abuse or violence, Melanie had no power over Timothy. There were no power imbalance/power dynamics in their relationship. Melanie had neither control or possession over Timothy
160
160/300
Timothy & Melanie were on speaking terms up until September of 2017, just months before Timothy released her statements. I won't go into further detail out of respect but please remember that staying friends with people who abused you doesn't make you guilty by any means.
161
161/300
And again please don't misinterpret it or twist it: This section is just the timeline of events. Timothy didn't lie about their friendship. She stated that they remained friends in 2015 which is true. But she also stated that the friendship ended in 2016 and that's false.
162
162/300

Because, we can provide enough proof to show you that they actually stopped being friends in 2017. For illustration purposes only: The following examples are interactions they had over the years.

Chapter Five: Addressing the incident of November 16th, 2017
181
181/300
On 11/16/2017 Timothy posted two tweets. On the same day, Melanie allegedly tried to contact Timothy and her boyfriend which ended up with both of them blocking Melanie. Newsweek vouched for Timothy, claiming that they'd seen the alleged phone recordings and text messages
Media image
Media image
182
182/300
Note: I have seen people using the terms "phone records" & "phone recordings" interchangeably. When I use the term "phone recordings" I'm referring to the call logs. Timothy claims that a phone call didn't took place: She accepted the call but hanged up immediately after.
183
183/300

For those who don't know: Newsweek is not a reliable source. They have been embroiled in multiple controversies surrounding sexism, plagiarism and prioritizing sensationalism over quality journalism. Here is an excerpt from an article made by Jonathan Alter in Feb. 2018:
Media image
184

One of Timothy's in real life friends also corroborated her November 16th, 2017 story. This person is not a public figure and for safety purposes I'm going to refer to them as "Blue Shirt." Respect this person's privacy and don't try to contact them or reach out to them.
186
186/300
We can confirm that this is a friend of Timothy because on 12/04/2017, Timothy liked and retweeted their tweet. The caption reads: "A lot of text, but here's my response to the Melanie Martinez story and my support to my friend."
Read in full before continuing the thread:
Media image
Media image
Media image
187
187/300
According to Blue Shirt, they were present at a bar in Downtown LA along with Timothy, her boyfriend, and another friend of Timothy when Melanie allegedly tried to contact Timothy and her boyfriend with no avail. Timothy's November 16th tweet was posted around 10pm GMT-7.
Media image
Media image
188
188/300
But we will come to learn that Blue Shirt isn't a reliable source. Just to be clear: I'm not saying that they're lying or that they're not being honest. I'm stating that their statements are solely their perspective / interpretation of the events that occurred that night.
189
189/300

Just like Timothy's recounting of events during her sleepover with Melanie, Blue Shirt's recollection of events can't be perceived as one-hundred percent accurate. That's because a testimony coming explicitly from memory can be misconstrued (i.e., reconstructive memory).
190
190/300
To give a better example: When asked who ended their friendship between Melanie & Timothy, Blue Shirt said that it was Timothy who ended the friendship, not Melanie. But in Timothy's original letter, Timothy said that Melanie was the one who ended the friendship, not her.
Media image
Media image
Media image
191
191/300
Unlike Timothy, who purposely lied and gave the wrong date of the alleged assault while having presumed documented evidence on her possession which provided her with the real date of the sleepover, Blue Shirt gave a wrong answer because they were recalling it from memory.
192
192/300
With "presumed documented evidence," I'm referring to possible text messages, social media posts and archives. If Timothy's claims that her iCloud was messed up were true (which it wasn't), she could had relied on other alternatives to give an accurate date of the events.
193
193/300
But that doesn't mean Blue Shirt is purposely lying, it just means that they are not a reliable source. Neither Timothy, Timothy's boyfriend at the time, Blue Shirt or Newsweek had publicly showed or released the alleged phone recordings or the presumed texts Melanie sent
194
194/300

This has led to people coming up with theories such as:

• The entire incident was a hoax, the phone call and texts never happened, and Blue Shirt is lying on her behalf.

• The phone call did in fact happened but Blue Shirt was never present at the time of the events.
195
195/300
• Timothy lied and staged an incident to make it look like Melanie was trying to get in contact with her unbeknownst to Blue Shirt so she could later use their testimony as alibi.
• The event occurred but the reason why the phone recordings are private is still unknown.
196
196/300
Note: Go rewatch the video from tweet 122/250 before continuing. Also, for clarity purposes, Melanie's personal healer and Melanie's psychic are the same person. The terms "healer" & "psychic" are used interchangeably throughout the interview and other social media posts.
197
197/300
Timothy expressed on Newsweek that Melanie reached out to her on Nov. 16 as a result of Melanie dreaming about Timothy. But on the interview that she did on 12/09/2017, she stated that Melanie reached out to her as a result of reading the tweets that she posted on Nov. 16
198
198/300
Melanie's psychic was also mentioned on the alleged text messages Timothy received on Oct 2016 after Melanie unfollowed Timothy on social media. The term "social media" is used in a broader sense on the 12/09/2017 interview, since no social media app was mentioned by name
199
199/300
Due to conflicting reports it's unclear who reached out to whom as a result of Melanie unfollowing her on social media. Oddly enough, I found a video from a fan proving that Melanie was still following "Dresses The Band" (but not Timothy herself) on IG around Nov. of 2018
200
200/300
Without the intention of sounding condescending, I also need to point out that the alleged text messages from October of 2016 (just like the text messages and the phone recordings from November 16th, 2017) have not been publicly released for reasons that are still unknown
201
201/300
Timothy stated that after Melanie unfollowed her on social media and after having a long conversation with her via text messages that those were the main reasons why their friendship ended on October of 2016, regardless, there are opposing statements that contradict this.
202
202/300
While Timothy stating that the last interaction she had with Melanie was on October 2016 aligns with Newsweek claims that the 11/16/2017 incident was the first time Timothy heard from Melanie in over a year, archives from Timothy's social media makes her claims unfounded.
Media image
203
203/300
There are people trying to explain Timothy's posts in which she stated that they were still friends in 2017. For example, explaining that the friendship ended in 2016 and Timothy was still in a one-sided friendship with her. I advise everyone to form their own conclusions
Media image
204
204/300
Returning to Timothy's recounting of events from 11/06/2017, Timothy claimed that Melanie tried to contact her 20 mins. after posting her tweets. This is unlikely because Melanie is not a social media person and she is known for taking months-long breaks from the internet
205
205/300
To get my point across better: Melanie's last tweet before 11/16/2017 was on 09/28/2017 and Melanie's last liked post on twitter before 11/16/2017 was on 10/30/2017. Granted, twitter doesn't tell people when someone is active online so take this info with a grain of salt.

And on December 2nd 2017, two days before posting her statement, Timothy tweeted the following: "I have enough friends and you are NOT ONE, AND NEVER ACTED LIKE ONE EITHER." It has been speculated that this tweet was referring to Melanie.

All of these explanations are purely speculations and should not be taken as a fact. Unfortunately, we don't have a definite answer as to what really happened on the night of 11/16/2017. The only thing we can do is make a good judgement and don't rely on people's biases.

I want to end this chapter by highlighting the importance of media literacy: While addressing topics like this it is essential to be a conscientious person and be critical with the media/content we consume. The next tweet are the sources that I used on my previous tweets.

Note: Twitter limits tweets that have broken links and tweets that include more than one URL so I'm going to upload a photo of all the sources missing instead of typing every single one individually. It takes less than a minute to type each URL to prove their authenticity

Chapter Six: Addressing some misconceptions and rumors people have regarding Melanie Martinez and Timothy Heller over the years
Media image
211
211/300
Misconception #1: "Timothy Heller had no initial support when she came out with her statement."

The #MelanieMartinezIsOverParty was trending worldwide at #1 with over 1.2 million tweets with people burning Melanie's merchandise and sending her death threats/rape threats.
212
212/300
They also doxxed her old home address and were sending letters to her record label harassing them to end her contract. Timothy's original statement had almost 200K likes (screenshots found via Wayback Machine), so the argument that Timothy had no initial support is a lie.
Media image
213
213/300
Misconception #2: "No news media covered the allegations when they surfaced."

Multiple news media covered the topic back in 2017 such as CNN and CBS. Just to give a quick example, you can watch a Billboard video addressing the subject matter here:
youtu.be/ZH6EVNZA8e0
214
214/300
Misconception #3: "Melanie deleted her original statement so that counts as an admission of guilt / confession."

Melanie had a bot which deletes all of her tweets one year later after being posted. Circleboom is a Twitter bot for example.

Media image
215
215/300
Misconception #4: "Melanie took advantage of Timothy because of her age."

Timothy is older than Melanie. Timothy was born on August 17th, 1992 (32 years old) and Melanie was born on April 28th, 1995 (30 years old). They met when Timothy was 22 and Melanie was 20 in 2014.
216
216/300
Misconception #5: "Melanie was never supportive of Timothy's career."

Melanie was always supportive with Timothy's career. Timothy's former band "Dresses" were the opening act for Melanie during The Dollhouse Tour back in 2014 along with Mike Squillante (wearemovienight)
Media image
217
217/300

Misconception #6: "Melanie is still guilty under the eyes of the law."

The California Court System (2023) states: "Everyone accused of a crime is legally presumed to be innocent until they are convicted." Since the case never went to trial, both of them remain innocent.

Misconception #7: "Timothy copied her story from a sexual assault survivor."

Timothy denied the rumors on a TikTok video that you can find on Misconception #20. Here's the story which was posted on Jan. of 2013. Be cautious and be safe 🧡

Misconception #8: "Miles wasn't aware about what happened between Melanie & Timothy."

Miles was Melanie's boyfriend back then. Miles, Melanie, Timothy & Timothy's ex-boyfriend used to be friends. Miles knew beforehand that Melanie was attracted to/interested in Timothy.
Media image
220
220/300

Timothy was aware that Miles knew that Melanie had feelings for her. Both Melanie & Timothy had prior dialogues about having sex before engaging in a sexual activity together, this could very well indicate that their encounter during the sleepover was planned/consensual.
221
221/300
She changes her answer after noticing that her remark would've made people realized that she & Melanie had already talked about having sex prior to their sleepover. The only way for Timothy to know that Miles wouldn't care about it is if Miles had become aware beforehand.
222
222/300

Misconception #9: "Globelamp, who was former friends with Timothy, came forward and exposed Timothy as a liar."
On September of 2020 Elizabeth Gomez posted a series of stories on her IG page denouncing Timothy. But take her statements with a grain of salt. Pause to read.

Don't get me wrong: Globelamp is a bad person. But don't send hate to her. People use the argument that because Globelamp is a bad person she can't be trusted, ignoring the fact that Timothy purposely befriended someone so they could talk bad about Melanie on her behalf.

Misconception #10: "Timothy compared being sexually assaulted to being stabbed."

Timothy's friend Eve was the one who made the insensitive comments, not Timothy. They stopped being friends after it was revealed that Eve was in a groupchat being inappropriate with minors.
227
227/300

Proof of Eve sending scantily clad pictures of herself to minors. Some sources state that she was born on 1995 so that would make her around 22-23 years old when this happened.

Misconception #11: "Melanie Martinez is rude to her fans."

Melanie has never been rude or mean to her fans. She has always been vocal about how much she appreciates the love she receives from her supporters. Here is a snippet from a 2019 interview.

Her older songs like A Million Men and Rough Love (both made in 2013) were written to show empathy and raise awareness about sexual abuse. In Melanie's words: "It's important to practice love & empathy, as well as to do inner work in order for your outer self to blossom."

Trigger Warning: CSAM
Misconception #12: "Melanie posted CSAM on her old Tumblr."
What people are referring to was when she answered a fan question on Tumblr. The fan asked which was her favorite episode of iCarly and she answered it with an edited gif of Jennette McCurdy
Media image
234
234/300
Out of respect of Jennette McCurdy I'm not going to post the edited gif. But rest assured, it wasn't CSAM. The edited gif came from a season 3 episode called "iWas a Pageant Girl." As you can see the scene which the edited gif originated from is in no way sexual in nature
235
235/300

"iWas a Pageant Girl" is Melanie's favorite episode of iCarly because it reminds her of her childhood when she used to play as a fashion model. It is important to point out that Melanie herself didn't make the gif as it was suggested to her by Tumblr Gifs Search Results.
236
236/300
The most likely explanation is that Melanie wanted a gif from that episode, found a gif who was recommended to her by Tumblr, didn't thought much of it & ended up using it. Not justifying what she did but people's reactions got blown way out of proportion for using a gif.
237
237/300

Misconception #13: "Melanie Martinez fetishizes babies and romanticizes mental illnesses."

The Album Cry Baby is a metaphorical and exaggerated representation of a character named Cry Baby, who is loosely based / inspired on Melanie's personal experiences and upbringing

Misconception #14: Explaining the dice-rolling situation
Timothy previously stated that she was abused by Melanie while playing a Valentine's Day Kit together. But there's one small detail that not a lot of people seemed to had pointed out: The Kit was a dice-rolling game
240
240/300
The following note is purely speculation & it shouldn't be taken as a fact. This is Blank's old input regarding the dice-rolling situation as they are indecisive as to how interpret Timothy's statements that she gave addressing the Valentine's game while being interviewed
Media image

Misconception #15: "Edwin Costa didn't know who Timothy was before he made his video series."

Edwin & Timothy already knew each other. He didn't have any problem making a video series attacking Melanie & then deleting comments that were calling him out for omitting info.

Misconception #16: "Teacher's Pet is about Adam Levine"
In The October 2019 Issue of Alternative Press, Melanie stated that Teacher's Pet was based on her childhood experiences of seeing teachers being arrested for being inappropriate & grooming their students on the news
Media image
243
243/300
"I remember as a kid when a teacher would get reported with a student, the news would portray it as a teacher-student affair instead of calling it what it is, which is abuse and really just that teacher exerting the power of their age over a child"

Misconception #17: "Melanie Martinez is into DDLG (Daddy Dom/Little Girl) & ABDL (Adult Baby Diaper Lover)."

Misconception #18: "Melanie Martinez is a satanist."

246

Misconception #19: "Melanie scammed her fans with an AI Meet & Greet."
The package said "Access to the Interactive Portals Photo Experience." I know that the word interactive is a buzzword for AI but it was just a video of Melanie meeting people that she filmed beforehand
247
247/300

Misconception #20: "This thread is full of victim-blaming."

The act of recollecting data is not victim-blaming. Disproving presented evidence is not victim-blaming. Pointing out that an alleged victim of sexual assault purposely falsified evidence is not victim-blaming.
248
248/300
I caught on that the fandom is always going to be perceived as wrong no matter the context: When we provide no evidence we were being rape apologists, when we provide enough evidence we are being insensitive, but if we provide too much evidence we are also victim-blaming.
249
249/300

When presenting evidence in any case it is vital to decide how important/believable your evidence is. The more relevant/valuable your evidence is, it will have more influence on the people you want to convince. If your evidence has no weight then people can't rely on it.

Chapter Seven: Explaining The Meaning Behind Piggyback And Why It's Not A Diss Track

"Piggyback" is Melanie's third & final statement regarding the accusations to this day. Melanie's way to cope is through her music & her art so she wrote a song as a means of expression.
Media image
251
251/300
I could write an analysis of the song but its purpose is self-explanatory & its message is crystal clear: Piggyback is Melanie's life story. The song is Melanie finally taking a stand against every single person who took advantage of her trust for their own personal gain.
Media image
Media image
Media image
Media image
252
252/300
If Melanie's true motives were to profit off the situation she would have released the song across all of her streaming platforms. Instead, the song was only officially released on SoundCloud where the site has the option to stop monetization of any song at any given time
Media image
253
253/300
Atlantic isn't credited on SoundCloud, meaning that her label didn't provide her any of the equipments to make that song. Melanie produced it on her own. There's also speculation that Melanie's healer Raven helped her write it but I couldn't find any proof for that claim.
254
254/300

Melanie did not insult anybody. The harshest term she used were the words "fake people," "plastic people" and "liars." Compare it to a real diss track like “Ms. Whitman” by Bhad Bhabie where she used terms like "bitch," "whore" and "stanky pussy."
youtube.com/watch?v=yo7_px…
255
255/300
On Piggyback, Melanie describes someone as their “one best friend.” This person is Jacqueline "Jackie" Molina. Jackie and Melanie have been friends since they were 5 years old in kindergarten and they are still friends to this day. Timothy was never Melanie's best friend.
256
256/300
What Timothy & Maddie like to do is to tell everyone that Melanie has no real friends to convince people that Melanie is possessive/abusive. Here you have old tweets from Maddie claiming that Melanie has no real friends and people only surround with her for monetary gain.
Media image
Media image
Media image
Media image
257

These comments come from a place of anger rather than out of concern. You can be friends with your workmates while maintaining a healthy relationship with them. If Jackie didn't want/didn't like the job that is solely her decision to make.

What Maddie Carina is trying to do is convince people that being a bad friend or a bad person is synonym with being a sexual abuser, which is a false analogy fallacy (the assumption that two things share multiple similarities simply because they have one thing in common).
Media image
259
259/300
You can find Jackie's name on the Cry Baby Credits. Neither Timothy or Maddie was mentioned in the acknowledgements. Another detail is that in the day "Piggyback" was released Jackie uploaded via Instagram stories an old picture of her with Melanie, showing her support ❤️

Chapter Eight (260/300): The Maddie Carina Allegations
Around the time Timothy posting her letter, Maddie also shared her alleged story of abuse. She claims that Melanie coerced her into having a sexual encounter during an unspecified party. But be wary of her statements.
Media image
Media image
261
261/300
Timothy and Maddie have been friends for years before 2017. Considering "Blue Shirt" giving wrong statements in the past, Globelamp admitting that she has lied and Eve's lack of humanity to be sexting minors, Timothy's friends (including Maddie), are not reliable sources.
262
262/300
I can make the same argument that Maddie & Timothy keep accusing Melanie of being an abuser with no evidence or testimonies. And people just keep taking their words for granted without doing any research. But my issues regarding Maddie's accusations go beyond these points
263
263/300
I have a problem with them using the terms "hooking up" & "sleeping together" as synonyms for "sexual abuse" & they never correcting themselves. They should know the difference between those terms & how to use them properly considering that they're SA survivors advocates.
264
264/300
It's also not common to be submissive to someone who's physically weaker, highly shorter & biologically younger than you, especially if that person isn't a figure of power. It's haunting that Timothy & Maddie allegedly decided to respond passively instead of authoritarian
Media image
265
265/300
But the most infuriating part is Maddie messaging Edwin Costa (a youtuber who is friends with Timothy) to accuse Melanie of flying people outside the US border so Melanie could have sex with them. There's no other way to say it: Maddie accused Melanie of human trafficking
Media image
Media image
Media image
266
266/300
The conversation between them was never meant to be public. The reason why we know about this is because Edwin was hacked. Maddie was comfortable enough to falsely accuse Melanie of human trafficking in private was because she couldn't have foreseen the texts being leaked

Falsely accusing someone you hate of human trafficking because you can't substantiate your false allegations of abuse is not ok. Disappearing from social media when people started to call you out for it is not ok. Not taking accountability for your own actions is not ok.

Maddie claims that Melanie has more victims but it has been over six years and no one has ever come forward. Not a single person claiming to had been human trafficked & abused by Melanie. There are no victims because it's all a lie. Maddie lied. I can't stress this enough
Media image
Media image
Media image
269
269/300

There's no justification for falsely accusing Melanie of human trafficking. If Melanie was truly a human trafficker, Maddie should've reported her immediately instead of wasting people's time & messaging youtubers about it. Maddie & Edwin should be ashamed of themselves.

Chapter Nine
You may be asking yourself: Why does Timothy keep insisting that she's telling the truth when she isn't? As much as I would like to give my opinion I'm confident that this thread speaks for itself. Here are the reasons of people that were personally affected:
271
271/300
On Piggyback, Melanie gives two reasons as to why Timothy lied: As a ruse to get famous & as retaliation because Timothy considers her a bad person & a bad friend. Globelamp gave another reason as to why Timothy lied, that being Timothy was bitter about Melanie's success.
272
272/300

Timothy has stated how much she wants to be left alone and Cry Babies/Earthlings are the ones who keep bringing up the accusations. Yet every time Melanie has a new project, or Melanie begins to get recognition for her work, she fusses over to ruin it.

Keep in mind that Jimmy was 14 when Timothy (being 25 at the time) reached out to him to talk about her alleged abuse in great detail which is extremely inappropriate. Adults shouldn't be talking about sexual abuse to minors unless it's a qualified teacher or an educator.
