Once again, with situations like this, we tend to see an overreaction to every development. I understand it - we are still in May and not much is happening in the NFL. But the DA's decision not to charge Jacobs right now does not mean the case is over. Far from it. 2/

Their statement gives us some insight most are glossing over. Wisconsin has a law on the books which says that arrests in domestic abuse situations is *mandatory* if probable cause exists that something might have occurred. In my experience the mandatory arrest policy... 3/

...is typically used only at the time an incident occurred so the parties are separated and nothing else can happen. But Wisconsin is different. They have a more stringent application of the idea. As the DA mentions in the statement, because of the policy they routinely... 4/

It often sounds like 'lawyer-speak' to cover all my bases, but I don't mention it for that. I'm not giving legal advice so I don't need to cover myself. I simply want you to have all the angles. One of those angles is that the DA, or a grand jury, can often see... 6/

...you aren't getting the full story. Jacobs is not being charged *right now*, but the investigation is still very much open and the chances of criminal charges is still on the table. But here's where things get murky. Why delay the decision if they "have it"? 8/

I think that's the crux of the legal issue as we sit here today. I'd venture a guess that the DA has some questions about what happened and about whether they can get a conviction or not. That does NOT mean it did or didn't happen. We have to stop thinking like that. 9/

The only question is not "did it happen" for our purposes, the only question is what can they prove? The DA is keenly aware of the situation - a celebrity, serious felony allegations - and they'll be careful with any charging decision. That's just smart lawyering. 10/

The added issue is that Jacobs' lawyers continue to state that they have exculpatory evidence and that it will aid in exonerating him. Again, I'm just guessing, but the DA won't want to go forward without looking at all sides of the case and that's a huge factor. 11/

What this has done for my opinion of the case, however, is make me think that my initial opinion that he may escape suspension in 2026 is getting closer to being correct. If he isn't charged I'd be surprised if the NFL suspended him. Yes, it's happened before. 12/

But if the facts are as muddy as Jacobs and his team want people to believe, then I doubt the NFL would substitute their judgment should charges not be filed. On the other hand, if charges are filed it means that the timeline for handling the case... #FFLegalUpdate 13/

...suddenly becomes the most important part of this situation. If the charges end up as felonies then it certainly pushes this to 2027. If they're misdemeanors it might be quicker, but even so I would expect his team to push this out past the season if at all possible. 14/

Today I feel more confident that Jacobs won't see a suspension in 2026. However, and this is a massive caveat - there is a ton of risk still involved for fantasy purposes. I'll give similar advice here that I gave last summer about Rashee Rice. 15/

If you want to trade on the margins there is profit to be had. But you can also wake up with a zero on your roster without warning should this case go badly. It comes down to risk tolerance, but I'm cautiously optimistic in my opinion as we sit here today. 16/
