Delhi HC is hearing ED's plea challenging adverse remarks made by the trial court against the agency while discharging Arvind Kejriwal and others in the Excise Police case.

Counsel for respondents says they are seeking time to file replies.

ED: To be frank, there is no need for a reply.

Bench to respondents: I do not understand why you don't file a reply. You should have filed a reply.

Bench: In the first hearing i was of the opinion that i need to decide whether the judge exceeded his jurisdiction while making those remarks. You said you want to file a reply and now you are saying you want more time.

Counsel says he did not appear last time.

ASG SV Raju: They only want to delay the proceedings.

Bench: I will take this up at 3 PM to 2:30 PM. Give a copy to all the people. Jisko bhi copy nhi mili hai wo le lijiy.

Respondents: My lady we have received copies.

Bench: I will give them one more week to file a reply.

Respondent asks for four weeks to file a reply.

ED: We have served to everbody. We will do it again.

Respondents say the judgment of the trial court runs into several hundred pages.

One counsel for the respondents suggests that this case may be heard after the CBI case.

Bench: We will take it up on April 2. You file your replies, let me go through it and then we will see after that. We will fix a date for the arguments after that. If they [ED] want to argue, they will argue; you can argue after that.

ASG SV Raju: My prayers have nothing to do with them [respondents].

Bench: We will keep it on April 2.

ASG: They are relying on the observations in appellate tribunals.

Bench: It's a very short date. April 2. Let them file replies.

Bench: Nothing is happening on April 2 anyway. Let the reply come.
